End User License Agreement ("EULA")

Accordo di licenza utente finale (EULA)

Non installare o usare il software prima di aver letto e accettato tutti i termini della licenza. Il permesso ad usare il software dipende dall'accettazione dei termini della licenza. L'installazione o l'uso del software da parte dell'utente sarà considerato come accettazione dei termini della licenza. L'accettazione legherà ai termini della licenza con un contratto legalmente esecutorio con la CyberLink Corp.

* POLITICA SULL’ATTIVAZIONE MPEG-2

Nel caso di riproduzione video o attivazione della registrazione della tecnologia MPEG-2, l’applicazione software raccoglie una parte del numero di serie del sistema HP al solo fine dell’attivazione. CyberLink non raccoglie alcuna informazione personale dall’utente.

* LICENZA DEL SOFTWARE E GARANZIA LIMITATA

Il presente è un contratto tra lei, l'utente, e la CyberLink Corp. ("CyberLink"). Usando questo software, si accettano i termini di questo contratto.

Se si accetta di concordare con queste condizioni, cliccare "Si". SE NON SI ACCETTANO I TERMINI DI QUESTO CONTRATTO, NON USARE QUESTO SOFTWARE E RIMUOVERLO IMMEDIATAMENTE DAL COMPUTER.

* CONCESSIONE DELLA LICENZA.

CyberLink, in quanto concessore di licenze, concede all’utente, il licenziatario, il diritto non esclusivo di installare i programmi software allegati (in seguito il "SOFTWARE") su un dato numero di computer in relazione al numero di licenze acquistare e di utilizzare il SOFTWARE secondo quanto previsto dai termini contenuti nella presente licenza. Non è consentito noleggiare, affittare, concedere in sub-licenza, modificare, alterare, decodificare, smontare, decompilare o creare un qualsiasi lavoro derivato dal SOFTWARE, o rimuovere qualsiasi avviso di copyright o di proprietà contenuto nel SOFTWARE. Non è consentito riprodurre il SOFTWARE tranne che per scopi di backup e limitatamente ad una sola copia. L’utente è a conoscenza che il SOFTWARE viene concesso in licenza e non venduto. Il SOFTWARE deve essere acquistato legalmente da CyberLink o tramite rivenditori autorizzati da CyberLink, in caso contrario l’utente non dispone dei diritti per l’uso del SOFTWARE. L’utente accetta che una volta attivato, utilizzato o installato SOFTWARE; l’utente non può rivenderlo ad altre persone o entità che accompagna la documentazione e il contratto di licenza. La rivendita causa la terminazione automatica della licenza di utilizzo del SOFTWARE. L’utente è responsabile dei rischi derivanti dall’acquisto o dall’ottenimento del SOFTWARE da reti e rivenditori non autorizzati o di SOFTWARE usato.

* PROPRIETÀ' DEL SOFTWARE.

CyberLink ritiene i diritti d'autore, titolo e proprietà del SOFTWARE e del materiale scritto ("Documentazione") indipendentemente dalla forma o dal mezzo sui quali l'originale o altre copie possano esistere.

* AGGIORNAMENTI.

Se la presente copia del SOFTWARE è un aggiornamento da una versione precedente del SOFTWARE, il software viene fornito sulla base di scambio della licenza. Al momento dell’installazione e utilizzo della presente copia del SOFTWARE, l’utente accetta di terminare volontariamente l’EULA precedente e di non continuare ad utilizzate la versione precedente del SOFTWARE o di rivenderla ad altre persone o entità.

* USO DI IMMAGINI CONCESSE IN LICENZA DA TERZI.

Si possono usare immagini , se servono, fornite nel SOFTWARE, che potrebbero essere concesse in licenza da terzi, per dimostrare o completare il suo lavoro creato dall'uso del SOFTWARE; a condizione di non usarle illegalmente o in modo immorale, né si può cedere il proprio diritto all'uso a terzi. CyberLink non fornisce nessuna garanzia o rappresentanza per i lavori dei suddetti terzi.

* LIMITAZIONI D'USO

Accettate di usare il SOFTWARE solamente per uso personale e per scopi non commerciali. Acconsentite inoltre che non Vi sono garantiti diritti né questi possono essere estesi per l'utilizzo del SOFTWARE con Contenuti Video MPEG-4 eccezion fatta per il caso in cui il Contenuto MPEG-4 sia venduto o consegnato a voi da un provider di contenuti che agisca sotto licenza della AT&T MPEG-4 Essential Claims e che possa legittimamente vendere o consegnare tali contenuti.

* GARANZIA LIMITATA.

CyberLink garantisce che il supporto su cui il SOFTWARE è registrato è privo di difetti di materiale o di lavorazione, sotto l'uso normale, per un periodo di novanta (90) giorni dalla data di consegna all'utente. Se dovesse esserci un difetto nel supporto, l'unica responsabilità di CyberLink's sarà quella di rimpiazzare il supporto difettoso che deve essere restituito a CyberLink o al fornitore assieme alla ricevuta che mostra la data di acquisto. Nel caso in cui la CyberLink non potra sostituire il supporto difettoso, la CyberLink, a sua sola discrezione, rimborsera i soldi versati non appena questa licenza sara cessata, oppure sostituira il supporto difettoso con una versione piu recente dello stesso software.

IL RPESENTE SOFTWARE E LA DOCUMENTAZIONE IN DOTAZIONE (INCLUSE LE ISTRUZIONI PER L’USO) SONO FORNITE "COSÌ COME SONO" SENZA GARANZIA DI ALCUN TIPO E NON SONO ESENTI DA ERRORI. INOLTRE, CYBERLINK NON ASSICURA, GARANTISCE, E NON HA NESSUNA RAPPRESENTANZA CONCERNENTE L'USO, O I RISULTATI DELL'UTILIZZO, DEL SOFTWARE O DELLA DOCUMENTAZIONE IN TERMINI DI CORRETTEZZA, PRECISIONE, AFFIDABILITÀ', CIRCOLAZIONE O ALTRO. L'INTERO RISCHIO DEI RISULTATI E DELLE PRESTAZIONI DEL SOFTWARE VIENE ASSUNTO DALL'UTENTE. SE IL SOFTWARE O LA DOCUMENTAZIONE DONO DIFETTOSI, L'UTENTE, E NON CYBERLINK O I SUOI RIVENDITORI, DISTRIBUTORI, AGENTI, O IMPIEGATI, DOVRA' ASSUMERE L'INTERO COSTO DI TUTTI I SERVIZI NECESSARI, RIPARAZIONI O CORREZIONI.

CYBERLINK DISCONOSCE TUTTE LE ALTRE GARANZIE, SIA ESPRESSE CHE IMPLICITE, INCLUSE MA NON LIMITATAMENTE ALLE GARANZIE IMPLICITE DI COMMERCIABILITÀ', IDONEITÀ' PER UN FINE PARTICOLARE E DI ANTI CONTRAFFAZIONE, INDIFFERENTEMENTE SE EFFETTUATE DA CYBERLINK, SU QUESTO PRODOTTO CYBERLINK. CYBERLINK NON GARANTISCE CHE IL SOFTWARE SARA' ININTERROTTO O PRIVO DI ERRORI. NESSUNA INFORMAZIONE O CONSIGLIO ORALE O SCRITTO DATI DA CYBERLINK, SUOI FORNITORI, DISTRIBUTORI, AGENTI O IMPIEGATI DOVRA' CREARE UNA GARANZIA O IN NESSUN CASO AUMENTARE LO SCOPO DI QUESTA GARANZIA E L'UTENTE NON DOVRA' FARE AFFIDAMENTO SU TALI INFORMAZIONI O CONSIGLI.

NE' LA CYBERLINK NE' NESSUN ALTRO CHE SIA STATO COINVOLTO CON LA CREAZIONE, PRODUZIONE O CONSEGNA DI QUESTO PRODOTTO SARA' RESPONSABILE PER DANNI DIRETTI, INDIRETTI, CONSEQUENZIALI O INCIDENTALI (INCLUSI DANNI PER PERDITE DEI PROFITTI DEGLI AFFARI, INTERRUZIONE DEGLI AFFARI, PERDITA DI DATI, PERDITA DI INFORMAZIONI DI AFFARI, O ALTRE PERDITE PECUNIARIE) CHE SORGANO AL DI FUORI DELL'USO O DOVUTE ALL'INCAPACITÀ' DI USARE TALE PRODOTTO ANCHE SE CYBERLINK SIA STATA AVVISATA DELLA POSSIBILITÀ' DI TALI DANNI.

Se altre garanzie dovessero esistere, saranno limitate alla durata di novanta (90) giorni dalla data di consegna all'utente. La responsabilità della CyberLink's per qualsiasi danno all'utente o a qualsiasi altra persona non eccede in nessun caso l'ammontare pagato per la licenza d'uso del SOFTWARE.

L'utente accetta di assumere la piena responsabilità, completa e unica per l'utilizzo del SOFTWARE per qualsiasi scopo. Inoltre accetta tenere indenne CyberLink da qualsiasi rivendicazione, procedimento, danno, costo e spesa derivanti dall'uso del SOFTWARE per qualsiasi scopo illegale o violazione di questa EULA.

Questo contratto costituisce l'intera intesa tra l'utente e la CyberLink Corp. Questo contratto è governato e interpretato secondo le leggi di Taiwan e dovrà beneficiare la CyberLink, suoi successori ed incaricati.

Qualsiasi appello o disputa tra l'utente e la CyberLink o contro qualsiasi agente, impiegato, successore o incaricato della CyberLink, siano essi relativi a questo contratto o ad altro, e qualsiasi appello o disputa relativi a questo contratto o alla relazione o obblighi contemplati in questo contratto, inclusa la validità dell'arbitrato di questa clausola, dovranno essere risolti a Taipei, Taiwan, facendo seguito all'atto di Arbitrato di Taiwan.

Questa versione localizzata del EULA è solo per riferimento. In caso di incompatibilità tra la versione localizzata e quella in inglese, prevarrà la versione in inglese.

End User License Agreement ("EULA")

Do not install or use the software until you have read and accepted all of the license terms. Permission to use the software is conditional upon your agreeing to the license terms. Installation or use of the software by you will be deemed to be acceptance of the license terms. Acceptance will bind you to the license terms in a legally enforceable contract with CyberLink Corp.

*MPEG-2 ACTIVATION POLICY

In the event of video playback or recording activation of MPEG-2 technology the software application will collect a portion of your HP system serial number for activation purposes only.

CyberLink will not collect any personally identifiable information from you for this.

* SOFTWARE LICENSE AND LIMITED WARRANTY

This EULA is an agreement between you, the end user, and CyberLink Corp. ("CyberLink"). By using this software, you agree to be bound by the terms of this EULA.

If you agree to abide by these conditions, please click "Yes". IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, PLEASE DO NOT USE THIS SOFTWARE AND PROMPTLY REMOVE IT FROM YOUR COMPUTER.

* GRANT OF LICENSE

CyberLink, as licensor, grants to you, the licensee, a non-exclusive right to install the accompanying software program(s) (hereinafter the "SOFTWARE") on a certain number of computer(s) in accordance with the number of the license you purchase and use the SOFTWARE in accordance with the terms contained in this license. You shall not rent, lease, sublicense, modify, alter, reverse engineer, disassemble, decompile, or create any derivative work of the SOFTWARE, or remove any copyright notice or proprietary legend contained in the SOFTWARE. You shall not reproduce the SOFTWARE unless for backup purpose and limited to one copy only. You acknowledge this SOFTWARE is licensed to you, not sold to you. The SOFTWARE must be lawfully acquired from CyberLink or through CyberLink’s authorized resellers otherwise you do not have a right to use the SOFTWARE. You agree that once SOFTWARE is operated, used or installed; you may not resell it to another person or entity accompanying the Documentation and the license agreement. Such resell will cause an automatic termination of your license to use the SOFTWARE . You own and are responsible for the risk in purchasing or obtaining the SOFTWARE from unauthorized networks and resellers or the used SOFTWARE.

* OWNERSHIP OF SOFTWARE

CyberLink retains the copyright, title and ownership of the SOFTWARE and the written materials ("Documentation") regardless of the form or media in or on which the original and other copies may exist.

* UPGRADES

If this copy of the SOFTWARE is an upgrade from an earlier version of the SOFTWARE, it is provided to you on a license exchange basis. Upon your installation and use of this copy of the SOFTWARE, you agree to voluntarily terminate your earlier EULA and you will not continue to use the earlier version of the SOFTWARE or resell it to another person or entity.

* USE OF PICTURES LICENSED BY THIRD PARTIES

You may use pictures, if any, provided in the SOFTWARE, which may be licensed from third parties, to demonstrate or complete your work created by the use of the SOFTWARE; provided that you should not use the pictures in any illegal or immoral manner, nor shall you grant your right to use to any third party. CyberLink does not provide any warranty or representation to these pictures from third parties.

*USAGE RESTRICTION

You agree to use the SOFTWARE solely for personal and non-commercial purpose. You also acknowledge that no rights are granted or may be extended to you to use the SOFTWARE with MPEG-4 Video Content unless such MPEG-4 Content is sold or delivered to you by a content outlet licensed under the MPEG-4 Essential Claims to make such sale or delivery.

* LIMITED WARRANTY

CyberLink warrants the media on which the SOFTWARE is furnished to be free of defects in material and workmanship, under normal use, for a period of ninety (90) days following the date of delivery to you. If there is defect in the media, CyberLink's sole liability shall be to replace the defective media, which has been returned to CyberLink or the supplier with your dated invoice and is shown to be defective. In the event that CyberLink is unable to replace defective media, CyberLink shall at its sole discretion either refund your money upon your termination of this license or replace it with the newer version of the same software.

THIS SOFTWARE AND ACCOMPANYING DOCUMENTATION (INCLUDING INSTRUCTIONS FOR USE) ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND AND ARE NOT GUARANTEED FAIL-SAFE. FURTHER, CYBERLINK DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE, OR THE RESULTS OF USE, OF THE SOFTWARE OR DOCUMENTATION IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS, OR OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU. IF THE SOFTWARE OR DOCUMENTATION IS DEFECTIVE, YOU, AND NOT CYBERLINK OR ITS DEALERS, DISTRIBUTORS, AGENTS, OR EMPLOYEES, ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICE, REPAIR OR CORRECTION.

CYBERLINK DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT, REGARDLESS OF WHETHER IT IS MADE BY CYBERLINK, ON THIS CYBERLINK PRODUCT. CYBERLINK DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY CYBERLINK, ITS DEALERS, DISTRIBUTORS, AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY AND YOU MAY NOT RELY ON ANY SUCH INFORMATION OR ADVICE.

NEITHER CYBERLINK NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THIS PRODUCT SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE SUCH PRODUCT EVEN IF CYBERLINK HAS BEEN ADVISED OF THE POSSBILITY OF SUCH DAMAGES.

Should any other warranties be found to exist, such warranties shall be limited in duration to ninety (90) days following the date of delivery to you. In no event will CyberLink's liability for any damages to you or any other person exceed the amount paid for the license to use the SOFTWARE.

You agree to bear the full, complete, and sole responsibility for using the SOFTWARE for any purpose. You also agree to indemnify and hold CyberLink harmless from any claims, proceedings, damages, costs, and expenses resulting from your use of the SOFTWARE for any illegal purpose or violation of this EULA.

Upon termination of this EULA, you should destroy the SOFTWARE and the Documentation and all the copies thereof and remove and delete the SOFTWARE from your hard disk or other storage device.

This EULA constitutes the entire agreement between you and CyberLink Corp. This EULA shall be governed and construed in accordance with the laws of Taiwan and shall benefit CyberLink, its successors and assigns.

Any claim or dispute between you and CyberLink or against any agent, employee, successor or assign of CyberLink, whether related to this EUL A or otherwise, and any claim or dispute related to this EULA or the relationship or duties contemplated under this EULA , including the validity of this arbitration clause, shall be resolved in Taipei, Taiwan, pursuant to the Taiwan Arbitration Act.

This localized version of the EULA is for reference only. In case of inconsistencies between the localized version and the English version, the English version will prevail.
